The Dividing Fences Act 1953 (opens in new window) which is outside the jurisdiction of council, provides information in relation to mutual obligations requirements, processes and property owner's rights in relation to dividing fences. Please contact the nearest Court House for more information.
Council does not regulate the style of fencing on residential properties. However, in the interests of the community, council recommends that fencing styles should be designed and constructed to be sympathetic with the character of the area in which they are located.
Where possible they should blend with the overall appearance of the streetscape.
Fences no higher than 2m above the surface of natural ground are considered self-assessable development and may be constructed to the property boundary, with no formal approval required from council.
Fences exceeding 2m above the surface of natural ground may require a discretionary approval from council and will require a Development Approval for Building Work.
Additional height restrictions apply in relation to the fencing of corner allotment and further advice should be sort before the commencement of works. Contact Toowoomba Regional Council Certifiers through your local service centre.
The construction of fencing bordering parkland will require consultation with council.
