On July 1, 2009 The Freedom of Information Act was repealed.
Two new Acts, the Right to Information Act 2009 and the Information Privacy Act 2009 commenced.
Right to Information is the Queensland Government's approach to giving the community greater access to information.
The Right to Information website contains all the links and information you will need to make an enquiry under the new Act.

Toowoomba Regional Council's Publication Scheme
Background
Council is committed to open and accountable governance. It therefore fully supports the Qld Govt’s policy to proactively publish public information.
Council already makes a large amount of information available to citizens in an open and friendly way. Information is available via its website, leaflets and numerous other publications.
From 1 July this year, two new State Government acts - the Right to Information Act and the Information Privacy Act – came into being. At the same time, the Freedom of Information Act was rescinded.
The Right to Information Act provides a legal right of access to information held by government unless it is deemed to be contrary to the public interest to provide that information.
To access or amend your own personal information held by council, an application must be made under the Information Privacy Act.

Corporate Information Branch is responsible for processing information requests made under the Right to Information Act.
Under the Act, council is required to have a Publication Scheme that gives the public access to a broad range of information.
Toowoomba Regional Council's Publication Scheme provides a guide to information routinely made available to the public.

Much of the information contained in the Publication Scheme is available on this website.
Information can be viewed or downloaded from the site free-of-charge. Free internet access is available at all of the region’s libraries.
If you are unable to find an item of information or need assistance, please let us know and we will do our best to help.
Information not covered by the publication scheme
Not all classes of council information are detailed in the publication scheme. Your request for unpublished information will be considered under the provisions of the Act.
While council will strive to meet the community’s disclosure expectations, it must also consider the need to protect commercially sensitive information, privacy principles and the public interest.

Applicants should
- Submit their application on the approved form
- Supply the application fee where applicable
- Provide sufficient information to identify the information required
- If acting as an agent for the applicant, provide the authority of the applicant
- If your application relates to your personal information, provide proof of your identity

There will be no charge for examining any Publication Scheme information contained on council’s website. There is no charge for applications to access or amend a person’s own personal information.
An application fee of $38.00 is payable when lodging an application for non-personal documents. There are also charges for processing and photocopying released documents.
When making a non-personal application, you will receive a notice of estimated charges and you will be invited to discuss options for reducing the cost.
